GENERAL CONDITIONS OF PURCHASE FOR DOROTHEE SAUSSET WEBSITE

These General Conditions of Purchase (hereinafter “GCP”) apply between:

The company DARSHINI SASU, whose head office is located at 7 Rue du Repos 07300 Tournon-sur-Rhône – France, registered under company number 912 338 894 00013,

Hereinafter referred to as “Dorothée Sausset”;

and

Any physical person or legal person wishing to make a purchase via the website www.dorotheesausset.com

Hereinafter referred to as “the Buyer”.

These conditions are intended to define the terms of distance purchase between Dorothée Sausset and the Buyer, from order to payment and delivery. They regulate all the stages necessary for the placing of the order and ensure the follow-up of this order between the contracting parties.

These terms aim to define the contractual relationship between Dorothée Sausset and the Buyer and the conditions applicable to any purchase made through the merchant site www.dorotheesausset.com (the “Website”), whether the Buyer is a professional or a customer. The acquisition of goods through the Website implies unreserved acceptance by the Buyer of these terms. These GCP will prevail over any other general or specific conditions not expressly approved by Dorothée Sausset. Dorothée Sausset reserves the right to modify its GCPs at any time. In this case, the applicable conditions will be those in effect on the date of the order by the Buyer.

ARTICLE 1: PRODUCTS

We draw the attention of the Buyer to the fact that the photographs illustrating our products may be slightly different from reality due to the settings of the Buyer’s screen and the lighting during the shooting.

In addition, as these are artisanal creations, the articles may have irregularities in the finish, differences in format and / or stone tones, inherent in this type of manufacture, which cannot be considered as defects. Dorothée Sausset cannot be held responsible, and the validity of the order cannot be affected.

The photographs, graphics and descriptions of the products offered for sale are only illustrative and in no way binding on Dorothée Sausset. The Buyer has the option of obtaining additional information by contacting Customer Service by email at: [email protected].

ARTICLE 2: ORDER

The Buyer declares to have read and accepted the terms before placing his order. The Buyer’s validation therefore constitutes acceptance of the GCPs.

After checking the contents of his order, the Buyer will confirm it during the payment stage.

Once payment has been made, Dorothée Sausset will send the Buyer, by email, a summary of the information entered on the order form. The invoice for the order will also be provided as an attachment to the email sent to the Buyer.

Dorothée Sausset reserves the right not to confirm an order at its sole discretion, for any reason whatsoever, relating in particular to the availability of products, a problem concerning the order received, an abnormal order, a foreseeable problem concerning the delivery or a dispute relating to a previous order. In this case, Dorothée Sausset will inform the Buyer no later than five (5) working days after the order has been registered and will refund the Buyer without delay. If one of the products in an order is unavailable, the rest of the order is shipped.

ARTICLE 3: PRICES / TAXES

Prices are displayed in Euros all taxes included (excluding delivery costs).

Customs taxes and formalities are the sole responsibility of the Buyer, unless otherwise indicated. The Buyer undertakes to check the possibilities of importing the products ordered with regard to the territory of the country of delivery.

Delivery costs and delay vary depending on the country and delivery service chosen. Dorothée Sausset reserves the right to modify its prices at any time but undertakes to apply the current prices which will have been indicated when the order is placed, subject to their availability on that date.

ARTICLE 4: PAYMENT

It is recalled that the fact of validating the order implies the obligation for the Buyer to pay the indicated price.

The Buyer has the option of paying for his purchases only by Credit Card. The accepted payment cards are: CB, MasterCard®, Visa®, American Express®.

During payment, the bank requests personal information from the Buyer in order to verify the identity of the cardholder and to validate the transaction. The Buyer must transmit his credit card number, depending on the type of the latter, the expiration date thereof as well as the cryptogram number (3-digit number appearing on the back of the bank card).

The Buyer represents and warrants Dorothée Sausset that when validating his order form, he is in good standing with the issuer of the payment card.

The debit of the bank card is immediate.

ARTICLE 5: DELIVERIES

Deliveries are made to the address indicated in the order form. Delivery costs and times vary depending on the country and delivery service chosen. Delivery times are indicative as communicated by carriers.

For all delivery methods: the risks are borne by the Buyer from the moment the products have left the premises of Dorothée Sausset. In the event of damage during transport, a protest must be made to the carrier. Any package returned to Dorothée Sausset because of an incorrect or incomplete delivery address will be reshipped at the Buyer’s expenses.

ARTICLE 6: WITHDRAWAL

The Buyer benefits from a withdrawal period of fourteen (14) days from the delivery of his order to return the product to Dorothée Sausset for exchange or refund without penalty, with the exception of the return costs which will be at his own expense. The risks associated with the return are the responsibility of the Buyer. The period of fourteen (14) days runs from the day the Buyer receives the item ordered.

Returns must be in the original packaging and the product must conform to that received. The products must be returned in perfect condition, complete (accessories, pouches, booklets, etc.) accompanied by an explanatory note recalling the Buyer’s contact details as well as his wish to receive a refund or a credit note valid on the Website. The Buyer must attach to his withdrawal request a copy of his invoice or any other element identifying the order and its holder.

For any return, the Buyer must inform Customer Service by email at [email protected]  who will communicate the address to return the item to.

Dorothée Sausset will, within fourteen (14) working days from the date of receipt and verification of the product returned by the Buyer, reimburse the payment received corresponding to the product, subject of the withdrawal. The refund will be made according to the Buyer’s wishes in the form of a credit note valid for six (6) months from the date of issue on the site www.dorotheesausset.com or a refund credited directly to his bank account.

All special orders of products not available on the Website and therefore requiring a specific request to Dorothée Sausset, will not be refunded.

ARTICLE 7: GUARANTEES AND SERVICE

The warranties only cover a manufacturing defect within one (1) year from the purchase of the product. Any damage resulting from improper use cannot be covered.

In the event of a defective product, the Buyer can send the product back to after-sales service. Before sending us the product, the Buyer agrees to send an email to the address: [email protected]. The Buyer is invited to specify if possible his order number, to explain the problem encountered with the piece of jewlery and to attach one or more photos showing precisely the defect. Dorothée Sausset will thus confirm to the Buyer by e-mail that the product is repairable or exchangeable and whether the Buyer can return it or not.

It will be up to the Buyer to keep any proof of this return. The return of goods is carried out at the expense and risk of the Buyer.

Upon receipt of the product in after-sales service, and if it is repairable or exchangeable, Dorothée Sausset will return the product at its own expense.

In the event that the defective product returned to Dorothée Sausset cannot be repaired, an identical product will be sent or a refund will be issued.

ARTICLE 8 : INTELLECTUAL PROPERTY

The Website and the content thereof are the exclusive property of Dorothée Sausset, which is the exclusive owner of the related rights including, inter alia, the intellectual property rights, or has been duly authorised in this respect by the right holders.

Any reproduction, distribution or downloading, in full or in part, of the Website, pages, data, text, images (photographs, drawings, logos, etc.), videos and/or any other element of the Website on any medium, through any process and in any location whatsoever in the whole world is prohibited and constitutes infringement.

The same applies for the trademarks shown on the Website, whose reproduction and/or distribution, in full or in part, carried out using elements of the Website without Dorothée Sausset express consent is prohibited.

ARTICLE 9 : PERSONAL DATA

1/ Each Party undertakes to comply with all the principles ad obligations applicable to the controller, as provided by the European General Data Protection regulation 2016/679 dated April 27th, 2016 (“GDPR”) and the French Loi Informatique et Libertés n°78-17 dated January 6th 1978 in its latest version in force (“LIL”) relating to the automated processing of personal data carried out from the Website.

The Buyer is informed, inter alia, that data (e-mail address, any other personal data voluntarily provided by the Buyer for identification purposes and the IP (Internet Protocol) addresses relating to his/her Internet connection, collectively referred to hereinafter as “Personal Data”), which he/she provides using the forms on the Website or by sending e-mails to Dorothée Sausset staff, are collected and processed by Dorothée Sausset for administrative and commercial purposes and, in particular, for the purpose of responding to his/her purchase.

Dorothee Sausset is in charge of Personal Data processing on its own behalf.

The aforementioned data shall be conserved throughout the period of time required for the purposes for which said data is collected and processed.

The Buyer is informed that in accordance with the provisions of the aforementioned GDPR and the LIL he/she shall have the right of access, the right to rectification, the right to object and the right to erasure regarding his/her personal data processed under this agreement. To exercise this right, the Buyer may send a written request to Dorothée Sausset by email to the following address: [email protected] .

The Buyer is informed that when he/she visits the Website, a cookie may be automatically installed on his/her browsing software. A cookie is an element which does not enable the Buyer to be identified but whose purpose is to record information relating to the Buyer’s browsing history on the Website. The Buyer may deactivate such cookie by changing the settings in his/her browsing software.

The Buyer has a right to access, delete and amend personal data communicated by cookies in accordance with the provisions set forth herein-above.

Personal Data collected and processed by Dorothée Sausset using the Website shall not be transferred or loaned, free of charge or against payment, to third parties.

2/ The Buyer is obliged to comply with the provisions of the GDPR and the LIL and criminal sanctions may be imposed for breach thereof. In particular, when he/she accesses personal data, he/she shall refrain from collecting, misusing and, in general, conducting any act which may infringe people’s privacy or reputation.

In this respect, Personal Data relating to Dorothée Sausset staff, which is made available on the Website, may not be collected and processed without the prior consent in writing of the person concerned. The Buyer shall refrain from collecting and using such Personal Data, through manual or automated processes, to send advertising messages or any other type of message which is not related to Dorothée Sausset business activities.

ARTICLE 10 : APPLICABLE LAW AND JURISDICTION

Those GCP are governed and construed in accordance with the laws of France. In the event that any disputes arise, the parties agree to use all god faith efforts to negotiate an amicable resolution to any dispute hereunder. If after good faith negotiations either party deems it necessary to initiate a lawsuit with respect to any controversy regarding this agreement, then the French law shall apply and the venue for such litigation shall be the French jurisdiction.
